Your Privacy

We (James Vine/Limited Edition Design) take your privacy seriously and committed to preserving the privacy of all visitors to our website. Any information you provide is solely to enable us to process your enquiry and provide a high level of service.

By registering or inputting your details on this website, you consent to the collection, use and transfer of your information.

Information that we collect from you
  • We may collect and/or use information about you from messages you post to the website and e-mails or letters you send to us.
  • If you subscribe to our mailing list, we will retain your email address, which will be added to our mailing list.
  • You may unsubscribe any time by using the unsubscribe link found at the bottom of the newsletter.
  • Your information will NOT be used, shown or sold to Third Parties.
  • We use Google Analytics for statistics. Google Analytics collect anonymous information about your visit. This helps both us and the website designer understand more about your visit. Please see below about Analytical Tracking Cookies below for more information.
Data Protection: We occasionally collect client's data during the process of carrying out a project. This data will not be shared with anyone else and will be stored in such a way as to not be available to anyone else. GDPR: We adhere to all GDPR protocols. Terms & Conditions

v1.1 (Oct 2021)

Projects: Projects will be proofed at every stage to obtain go ahead for either web development or print. Confirmation of approval is a binding contract for payment and billing up to that stage.

Project payment: We charge at the end of project. Payment must be received within 28 days of invoice date.

Payment terms: Payment is accepted by cheque or BACS (bank transfer) payment in UK Pounds Sterling. Cheques can be arranged at special request.

Contract: The client's approval for work to commence shall be deemed a contractual agreement between the client and James Vine/Limited Edition Design.

VAT: We do not charge VAT.

Cancellation: Should the client wish to cancel at any point during the process they shall remain liable for the work that has taken place and shall be invoiced accordingly unless circumstances out of their control render this not possible.

Delay of work: Should the project be delayed for any reason that is out of the control of James Vine/Limited Edition Design, an invoice may be raised for the work carried out so far; regardless of whether the project has been completed.

Quotations: The price quoted to the client is for the work agreed on the quotation only.

A new estimate will be supplied if the project description changes once work has commenced. An estimated 40% of our projects change path once project is in its final stages.

Payment: An invoice for the work completed will be sent by email and/or post upon satisfactory completion of the project and this may be before the services are published. Payment of this invoice will be due immediately and must be settled within 28 days from invoice date.

Accounts that have not been settled within 7 days of our final reminder will incur a late payment charge of 10% of the amount outstanding.

Outstanding charges at time of tax submission will need to provided to the HRMC as per their request at time of tax submission.

Any domain names and/or hosting and email services will be suspended if payment is not received. Multiple means of contact will be tried before turning off a website (hosting/email/domain names). You cannot send/receive email or even view old emails on webmail if you do not keep up with payments.

Material: All material supplied by the client belongs to the client and that it does not breach any copyright laws. Use of pre-purchased stock images must be used in a way that adheres to the stock photo's providers rules and terms of usage.

Print quotes: we routinely obtain up to 3 quotes for your print project. We pass over the price for either the best price, quality, or turnaround times that best suits your project and needs.

We do not charge to obtain these quotes if we designed your project.

If we did not design your artwork, but wish for us to arrange print and delivery: We may charge up to 20% of print quote as we'll have to make sure the artwork is "print-ready" before sending to the printers for print and delivery.

Print: We use third party printers to print your project. We cannot be help responsible for outstanding payments to printers. We reserve the right, after pursuit for payment, to report this to the HRMC when submitting our tax and/or pursue legal help to help cover the charges you incurred.

Domain Name Registration & Website Hosting Charges: The Client shall meet all third party costs arising from the registration of domain names and the configuration of any hosting, settings, domains and email outside of Limited Edition Design's own hosting, domain and email service. We will suspend any hosting and/or domain names and/or email accounts if any due invoices are unpaid on time or misused.

We routinely do not charge for hosting and domain renewal as a thank you for hosting with us. Your service is not impacted.

You will receive many forms of contact from us should an invoice be due and a service is about to be impacted.

If you wish to cancel, you reserve the right to do so. We do not own your domain name, we simply register or help maintain it during it's life with us - you fully own your domain name.

In the event that I have died or illness renders me unable to help further, domains can be tracked and traced by online software. Any other web designer or host can help find the paper trail. If you need to gain control of the domain or hosting in the event of my death or illness, process requires you to send ID and other information before the domain and hosting is passed over to you.

Intellectual Copyright:

Proofs = 100% copyright to James Vine/Limited Edition Design, unless paid for. If you do not pay, you do not own and usage of the designs, however far through, cannot be used. We reserve the right to collect evidence of usage and take matters further or bill accordingly.

Once chosen and paid for: 100% copyright to client.

Third-party designers/developers are not allowed to take credit for work initially created by James Vine/Limited Edition Design. Design work taken from existing print/web projects and used on new print/web projects by third-party designers/developers requires credit to James Vine/Limited Edition Design.

James/Vine Limited Edition Design showcase your designs to new and existing clients. If you wish for your project to be taken from our website, please do contact me as I'm happy to keep you from our site as per your requirements.

Website updates and maintenance: Unless requested, we are not responsible for the client's on-going life of your initial project. Updates to WordPress or code is sometimes required due to the ever-changing world of the web.

Search Engine Position or Promotion: Unless requested, we are not responsible for the client's on-going web site promotion. We will build the website with search engine optimisation in mind by using the latest search engine friendly techniques.

Your search engine rank will change over the course of its life. For better, or worse. As everyone is fighting for the top we will not and can not be held responsible for this, but, of course, during the production and lifespan of your website, if we are still the most current creators of your website, that we aim as help and guide as best we can.

Access to code or root files: If you want or have access to the code, original files and made changes, we reserve the right to disassociate ourselves from your project.

Third party interaction, code or text alteration or plugins can and will alter your position, for better or worse. We cannot be help responsible for external influences such third party interaction (another developer), code or text alteration (by you or your team) or plugins (such as SEO plugins that sometimes make things much worse).

You are free to purchase such advances like Google Adwords to promote your website further.

Future Support: The website is provided to and accepted by the client as a fully functioning, completed project. We are not responsible for future support and our liability of any loss of data is limited to the value of the project. Ongoing support can be provided upon request and for an agreed fee. Future changes to the website will be invoiced at our prevailing hourly rate. Limited Edition Design is not responsible for any loss or damage caused by the supply of digital files, printed media, CD or DVD discs. Limited Edition Design endeavour to ensure that any digital files supplied via email or disc are virus free.

Freelance use: For advanced web projects, we use a freelancer with experience in this field.

Future Problems: Malicious spy ware, viruses and website hacking are facts of life on today's Internet. It is unlikely that these will affect your website, and we will endeavour to protect it from this as much as we can and help get it back online.

James Vine/Limited Edition Design or any of our freelancers cannot and will not be held responsible for data breaches, hacks or other misuse pertaining to your website. We will endeavour to make your initial project as robust and future proof as possible to help guard against these attacks. In the case of data breaches, attacks or hacks help to get you back on track as best as possible, if possible, with analysis of the problem and how to fix it. As with updates, security or the ever-changing web-world, we cannot assure your website is protected 100% from such attacks.

Advanced projects: If your advanced project is imperative to the functioning of your business, then James Vine/Limited Edition Design, or use of freelancers associated with James Vine/Limited Edition Design should not be considered, even if our skillset outweighs that of a larger design or development organisations . James Vine/Limited Edition Design is a sole trader and a more robust solution for your project may be required. Our charges may be much more reasonable than larger design or development organisations, but at the end of the day James Vine/Limited Edition Design is still only a sole trader and time is limited, leave required or illness an issue.

Functioning without advanced projects: Due to hacks, attacks and other volatile and unpredictable behaviour on the web, it is imperative that you, your business or your team can function without the online project we helped create. We cannot help run your business, but we more than strongly recommend having offline resources as a back-up available and not to rely on online only solutions, ie. if the online version of your setup fails, like an online shop or data collection database, you need to be able to be fully functional until the online version is reinstated or another route has been chosen.

Loss: Limited Edition Design is not liable for any consequential loss to either data nor funds due to the website being offline for any reason. There are occasions when maintenance or upgrade work is required to be carried out on the server where the client's website is stored. If this is the case we will notify the client if we get notification, however, downtime is usually caused by an issue that either needs rectifying or . Downtime is usually just a few hours and is extremely unlikely. Our liability is limited to the initial value of the project.
